MEMBERSHIP TERMS

If you agree with the following terms, please submit a complete and executed version of this form. If your application is accepted, this agreement shall be binding, and your card will automatically be billed as detailed hereunder. Please note, we are working to curate a community of padel enthusiasts. As such, please allow up to one week for our team to approve and process your application.

HEALTH ATTESTATION

The undersigned attests that they are healthy and fully physically able to participate in the activities offered by Padel Haus (“the Club”), including an exercise or sports regimen of their choosing, without undue risk of injury or other loss.

MEMBERSHIP PAYMENTS

If accepted as a member, the undersigned agrees to pay the initiation and annual or monthly membership fees outlined below.

 

A) If you elect to join an annual membership tier, the initiation fee as well as the first year’s membership fee shall be billed on the Commencement Date of Membership to the credit or debit card whose information is provided in this form. Beginning the second year of the membership period, and for all subsequent years, the yearly membership fee shall be billed on an automatic recurring basis on the 31st of the month corresponding to the Commencement Date of Membership, unless membership is canceled. 

 

B) If you elect to join a monthly membership tier, the initiation fee as well as the first month’s membership fee shall be billed on the Commencement Date of Membership to the credit or debit card whose information is provided in this form. Beginning the second month of the membership period, and for all subsequent months, the monthly membership fee shall be billed on an automatic recurring basis on the 31st of each month, unless membership is canceled.

 

C) All Membership Payments are non-refundable.

CHANGES TO MEMBERSHIP DUES

We review our Membership Dues periodically and may change them from time to time. This may result in an increase to your

Membership Dues after the initial Commitment Period. We will give you at least 14 days’ notice of any change and the date from which the charge will apply by emailing you at the email address you have provided to us. If you do not wish to accept an increase in your Membership Dues you may terminate your membership.

ACCESS & USE

Members will have access to and use of Padel Haus facilities and enjoy all presently available amenities, offers, and services during

business hours so long as all Membership Payments are current. Membership amenities, offers, and services, including pricing for

such amenities, offers, and services, are subject to change. Any forthcoming changes shall not go into effect until the first day of the

subsequent month. Members shall be notified at least one week prior to the implementation of any such change, providing them the

right to cancel their membership, as detailed in section 4 hereunder, prior to its effective date.

A) Members will strictly abide by all posted codes of conduct, safety guidelines, and regulations while using the Club’s facilities.

 

B) Padel Haus reserves the right to revoke any person’s membership if any of the terms of this agreement or any Club rules are violated or if there is any concern regarding the health or safety of any person or the integrity of any property.

CANCELLATION RIGHTS

A) YOU MAY CANCEL THIS AGREEMENT WITHOUT ANY PENALTY OR FURTHER OBLIGATION WITHIN THREE (3) BUSINESS DAYS FROM THE DATE LISTED ON THIS AGREEMENT. To exercise this cancellation right, you must notify Padel Haus in accordance with the below. Within fifteen (15) business days after Padel Haus receives notice of such cancellation, it will refund all amounts previously paid under this Agreement to the original method of payment.

B) ADDITIONAL RIGHTS TO CANCELLATION: You may also cancel your Membership and this Agreement, at any time during or after the Initial Period, for any of the following reasons and, if applicable, you may receive a pro-rated refund of Annual Membership Dues:

 

(1) If upon a doctor’s order, you cannot physically receive the services because of a significant physical disability for a period in excess of six (6) months, as evidenced by a signed letter from your doctor or other reasonable proof of your significant physical disability;

 

(2) If you die, your estate will be relieved of any further obligation for Membership Dues payments under this Agreement not then due and owing or a pro-rated refund of Annual Membership Dues, as applicable, as evidenced by a death certificate or other reasonable confirmation of death;

(3)If you move your residence more than twenty-five (25) miles from any Club operated by Padel Haus, as evidenced by reasonable proof of your new residency; or

 

(4)If the services cease to be offered as stated in this Agreement, i.e., they are no longer available or substantially available as stated in this Agreement due to Padel Haus‘ permanent discontinuance of operation or substantial change in operation.

 

C) You may exercise these rights to cancel your Membership and this Agreement by notifying Padel Haus in accordance with the below. Within fifteen (15) business days after Padel Haus receives notice of such cancellation, it will refund, using the Payment Information on-file, any prepaid unused Membership Dues and any prepaid unused Ancillary Charges. Any initiation fee you paid will not be refunded if you cancel your Membership.

D) Monthly Membership Cancellation after Initial Period: If you do not wish to continue your monthly Membership after the Initial Period, you may cancel your Membership and this Agreement upon fifteen (15) days’ prior written notice to Padel Haus. For clarity, your cancellation will go into effect fifteen (15) days after Padel Haus receives your cancellation notice; however, if you provide cancellation notice more than fifteen (15) days before the end of the Initial Period, your cancellation will not go into effect until the last day of the Initial Period. In the event that you do not notify Padel Haus at least 15 days prior to the expiration of the Initial Period, your monthly Membership and this Agreement will automatically renew at the end of the Initial Period on a continuous month-to-month basis until your Membership is cancelled by you or Padel Haus. All notices of cancellation must be provided in accordance with Section 3.4 of this Agreement. Padel Haus reserves the right, in its discretion, to require you to pre-pay all Membership Dues through the date your cancellation goes into effect. Please note you will not receive a refund of any Ancillary Charges, including without limitation for any sessions which remain unused at the time your cancellation goes into effect.

 

E) You are responsible for retaining (and presenting, if necessary) all records relating to your cancellation of Membership. In the event of a dispute as to whether and when notice of cancellation was received, Padel Haus’ records will control.

DISCLAIMERS & LIMITATIONS ON THE CLUB'S LIABILITY

The Club will not in any circumstance be liable or obligated for any exemplary, special, punitive, or consequential damages, including

any loss or damage of lost profits, revenues, or business opportunities, from any claim or dispute or whatever other source derived.
